NoPhlyZone All-You-Can-Eat and Drink Tailgate Event Liability Waiver and Damage Agreement
Please read carefully and acknowledge below.
By participating in the Online All-You-Can-Eat and Drink Tailgate Event, you (the "Participant") agree to the following terms and conditions:
1. Acknowledgment of Risks: The Participant understands that participating in the event and any related activities, including but not limited to consuming food and beverages, may involve inherent risks. These risks include foodborne illnesses, allergic reactions, and alcohol-related risks. The Participant assumes full responsibility for any risks, injuries, or damages, known or unknown, which might occur as a result of participating in the event.
2. Assumption of Risk and Release of Liability: The Participant hereby releases, waives, discharges, and covenants not to sue the event organizers, affiliates, officers, employees, agents, and sponsors (collectively, "Released Parties") from any and all liability to the Participant, his/her personal representatives, assigned heirs, and next of kin for any loss or damages, and any claim or demands therefore on account of injury to the person or property or resulting in death of the Participant, whether caused by the negligence of the Released Parties or otherwise while the Participant is for any purpose participating in the event.
3. Behavior and Damage Responsibility: The Participant agrees to be solely responsible for any damages that occur as a result of their actions during the event. This includes damages to the Participant's own property or injuries to themselves. The Participant agrees to indemnify the Released Parties for any damages or injuries caused by the Participant's actions.
4. Alcohol Consumption: The Participant affirms they are of legal drinking age and agrees to consume alcohol responsibly. The Participant acknowledges that the Released Parties are not responsible for any incidents, injuries, or damages resulting from or related to alcohol consumption.
5. Responsibility for Actions: The Participant is fully responsible for their actions and their consequences during the event. This responsibility extends to any injuries or damages the Participant may cause to themselves or others.
6. Governing Law: This agreement shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the event organizer is located.
7. Agreement to Terms: By acknowledging this waiver online, the Participant confirms they have read, understood, and agree to the terms and conditions stated herein. The Participant acknowledges that this agreement is intended to be as broad and inclusive as permitted by the laws of the jurisdiction in which the event takes place and that if any portion is held invalid, the balance shall continue in full legal force and effect.
By Purchasing a ticket, you acknowledge and hereby agree to:
- I have read and understood the terms and conditions of this Liability Waiver and Damage Agreement.
- I agree to assume all responsibilities and risks associated with participating in the Online All-You-Can-Eat and Drink Tailgate Event.
- I voluntarily sign the agreement, intending to be legally bound by it.
By typing your name above, you are signing this agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this agreement.
